You enter to agree to the Terms the moment you start using the Site and the Services provided on the Site. You’re given the rights to using the Services with such agreement. If you decline to agree, you will not be given any right to using the Sites and the Services.

The Site collectively refers to all sites under the openfoundry.org domain, and the Services refer to all services provided by the Site.

Unless otherwise stated, the Terms apply to all content and services provided by the Site.

You have the full intellectual property rights over the content that is created byyou and stored at the Site. You agree to grant OSSF, however, the following license over your content that is accessible to the public:

a.       Rights that are world-wide, royalty-free, permanent, irrevocable, non-exclusive to use, reproduce, modify, publish, edit, distribute, perform and display all or part of the above-mentioned content in any form, any media or any so far unknown or un-invented technologies.

b.      The rights to reveal statistical data related to the above-mentioned content for purpose of informing the public the performance of the OSSF.

Unless otherwise stated, intellectual property rights of the content provided by the Site ("the Content") are owned by Academia Sinica. The Content is licensed under Creative Commons 2.5 (Attribution -NonCommercial-NoDerives 2.5 Taiwan) and its later versions. You are allowed to reproduce and distribute the Content provided you observe these obligations:

a.       No commerical use is allowed;A statement that the intellectual property rights belong to Academia Sinica must accompany such reproduction and/or distribution;

b.      You are required to cite this article's text in full on intellectual property rights.

Your data stored in the version control system of OpenFoundry should be licensed under any of the licenses certified by OSI (Open Source Initiative) orOSSF.

In order to use the Services, you agree to obtain Internet connection and any tool required directly or indirectly to this connection on your own. You also agree to bear any expense incurred that is required to access the Site, including but not limited to connection service fee and equipment cost.

A number of the Services provided by the Site require you to register with your personal information. You will have to protect the account name and the associated password on your own.

Project websites that are hosted by OSSF’s web hosting service must inform the public clearly that such sites are hosted by OSSF. This includes the displaying of the OSSF Logo with a link to a designated page. Please refer to http://webhosting.openfoundry.org for more information on the logo, designated page link and other related issues.

The above-mentioned Logo must not be changed or modified for any reason or any purpose. For example, the logo’s size, type, color and other graphical characteristics must not be changed. If you need to do otherwise, please write to us for discussion.

OSSF does not provide warranty or guarantee of any kind for the non-OSSF content and therefore will not bear any cost or responsibility incurred.

OSSF is not responsible for any loss or incurred cost caused by any erroneous operation of yours, by computer virus, failed connection, theft, other interference or any misdeed listed in Article 12.

OSSF is not responsible for any diminishment or failure to storage of any of your information on the Site.

OSSF does not guarantee the accuracy and adequacy of any information obtained through the links provided by the Site or other third parties. OSSF takes no responsibility to any direct or indirect damage incurred by such linkage.

If an account or a project sees no activity for a certain period of time, OSSF reserves the right to mark such account or project as "idle". OSSF also reserves the right to file such account or project separately.

In the case that a third party files a claim, lawsuit or request for indemnification against you, you agree to take every necessary measurement to forsake the responsibility of OSSF and its staff and you will indemnify and defend for OSSF when necessary and maintain good will to OSSF.

In any of the following cases, OSSF may unconditionally suspend part or all of your rights to using the Site or the Services without any notice and may further forbid you to access to part or all of the Site:

a.       Any illegal or improper conduct such as Infringement, violation of law, violation of the Terms, or providing the Site with incorrect personal data; 

b.       Abuse of the Services by violating the Terms or the Law;

c.      Conducts that are against the purpose of the Site;

d.       Request to suspend the account filed by you;

e.       Conducts that cause damage to others;

f.       Any conduct that is against the purpose of the Services or is improper according to the Law.

If you have a reasonable suspicion for any infringement or that a conduct violates the law, you can write to OSSF with the following documents so that OSSF is able to investigate internally:

a.       Facts of such infringement or violation with sufficient data or information to prove the facts;

b.      Your real name, postal address, phone number and e-mail address;

c.       A written statement that you have reasons to believe the conduct in question is an infringement or violates the law.

If, after investigation, the reported infringement or violation is true, OSSF will remove the data item and notify you and other users that the item in question is removed or no longer accessible and take proper measures according to the Law.

If, after investigation, what is claimed by you does not constitute an infringement or violation, OSSF will write to you, excluding the cases if the reported facts in question already lead to legal procedures.

OSSF reserves the right to update and revise the Terms from time to time. The revisions will be announced at http://www.openfoundry.org/ and OpenFoundry.

Continuation of using the Services after such update and revision is taken as the acceptance of the new Terms.

Any part of the Terms that is ruled as void by the Ruling Court does not affect the effectiveness of other parts of the Terms.

The Terms are governed and construed in accordance with the Laws of Republic of China (Taiwan). Any legal claim proceeding or litigation arising in connection with the Service will be brought to the Taiwan Taipei District Court.
